Ormond Beach Deck & Fence is a state-licensed deck builder and outdoor structure contractor based in Ormond Beach, FL. We provide residential deck construction, fence installation, pergola installation, screened porch construction, deck repair and replacement, and related outdoor improvement services in Ormond Beach and surrounding communities.
Services are provided subject to a signed written contract between Ormond Beach Deck & Fence and the customer. No service obligation exists until a written contract is executed by both parties. We reserve the right to decline any project at our discretion before a contract is signed.
Estimates provided by Ormond Beach Deck & Fence are based on the information available at the time of the site visit and the scope of work described. Estimates are not binding contracts. A final price is established in a written project contract signed by both parties before work begins.
If conditions are discovered during a project that materially affect the scope of work or cost - such as rotted structural members, unexpected soil conditions, or changes requested by the customer - we will stop work and provide a written change order for approval before proceeding. No additional charges will be added without customer authorization.
Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. Pricing is subject to change based on material cost fluctuations after the estimate period expires.
Ormond Beach Deck & Fence will obtain all required building permits for permitted work on behalf of the customer unless otherwise stated in the written contract. Permit fees are the responsibility of the customer and are itemized in the project estimate. All work will be performed in compliance with applicable Florida building codes and local ordinances. The customer is responsible for obtaining any required homeowners association approvals prior to the start of construction.
Project start dates are estimates. Scheduling is affected by permit review timelines, weather, material availability, and prior project obligations. We will communicate scheduling changes to customers as early as possible.
If a customer cancels a signed contract before work begins, any costs already incurred by Ormond Beach Deck & Fence - including permit fees, materials ordered, or engineering costs - are the responsibility of the customer and will be invoiced accordingly.
Ormond Beach Deck & Fence reserves the right to suspend or terminate work on a project if the customer fails to make required payments as specified in the contract, or if site conditions make it unsafe or impractical to continue.
Payment terms are specified in the written project contract. Typical terms include a deposit at contract signing, a progress payment at a defined milestone, and a final payment upon project completion. Specific percentages and amounts are set per project in the contract.
Final payment is due upon substantial completion of the project as defined in the contract. A project is considered substantially complete when the work is finished and the final permit inspection has passed, or when the customer begins using the completed structure, whichever occurs first.
Invoices not paid within the timeframe specified in the contract may be subject to a late fee as stated in the contract. Ormond Beach Deck & Fence reserves the right to place a lien on the property in accordance with Florida lien law for unpaid balances.
Ormond Beach Deck & Fence warrants that all work will be performed in a workmanlike manner consistent with industry standards for residential deck and fence construction in Florida. The specific warranty period and terms for each project are set out in the written contract.
This workmanship warranty does not cover damage caused by acts of nature (including hurricanes, floods, or lightning), improper use or maintenance by the customer, modifications made by anyone other than Ormond Beach Deck & Fence, or normal wear and tear.
Material warranties are provided by the respective manufacturers and are separate from our workmanship warranty. We will assist customers in making manufacturer warranty claims where applicable.
Except as expressly stated in Section 7 above or in a written project contract, Ormond Beach Deck & Fence makes no warranties, express or implied, regarding services provided or information on this website. This includes, but is not limited to, any implied warranties of merchantability or fitness for a particular purpose.
Information on our website, including service descriptions and general cost guidance, is provided for informational purposes only and does not constitute a binding offer or warranty of any kind.
To the fullest extent permitted by law, Ormond Beach Deck & Fence's total liability to any customer for claims arising out of or related to a project shall not exceed the total amount paid by that customer for the specific project giving rise to the claim.
Ormond Beach Deck & Fence shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of income, or damage to property not directly caused by our work, even if we have been advised of the possibility of such damages.
In the event of a dispute arising from a project or these terms, the parties agree to first attempt to resolve the matter through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit the dispute to non-binding mediation before pursuing any other legal remedy.
If mediation is unsuccessful, disputes shall be resolved in the courts of Volusia County, Florida. Each party shall be responsible for its own legal fees and costs unless a court orders otherwise.
These terms and conditions, and any contract between Ormond Beach Deck & Fence and a customer, are governed by the laws of the State of Florida, without regard to its conflict of law principles.
Ormond Beach Deck & Fence may update these terms and conditions at any time by posting a revised version on our website. Changes take effect on the effective date shown at the top of this page. We encourage you to review these terms periodically. Continued use of our website or services after a change is posted constitutes acceptance of the updated terms.
